This site is dedicated to the struggles a father, Michael Smith, has had with
the California CPS system and his fight to regain custody of his daughter.

This summarizes what CPS did to Michael and his daughter.


Michael Smith's story started when he went to the Philippines in search of a young beautiful "mail-order bride" so he could have a family and a child. This search went horribly wrong.

Instead of having a happy family and a loving wife, Michael's new bride turned out to be a fraud. While she professed her love for Michael while still in the Philippines, at the same time she was being courted by him (a period of nine months), she was also communicating with several other American men, promising to love and cherish them as well. Despite her infidelity, disloyalty, and utter dishonesty, nevertheless Michael accepted her promises of faithfulness and profession of love, and brought her to the United States.

The result was a beautiful daughter, Angela, conceived in the Philippines and born in Palm Springs, California. Angela Smith and her father Michael are clearly a loving daughter and dad. Michael had the loving daughter he had longed for.

But soon after Angela's birth her mother's true intentions became apparent. She wasn't looking for a loving mate and family, but rather, a green card. Michael was nothing more than a means to an end. Angela's mother insisted that she wanted to have a work permit, supposedly allowing her to work in the US and send money back to her family in the Philippines. As soon as the work permit was received she then siezed on the opportunity to be independant. She no longer needed Michael. (Michael is not alone. To get rid of him, and avoid being deported for perpetrating a fraudulent marriage, she entered a domestic violence shelter and manufactured a false case of child abuse and spousal abuse. While there had never been any such abuse, in any form, nevertheless, Riverside County Child Protective Services accepted the allegations as fact, removing the child from Michael's home and branding him a child abuser on the Child Abuse Central Index (CACI). This was done without notice, hearing, or the opportunty for Michael to defend against the false allegations.

The stresses and time commitment involved in fighting endless battles with the County, forced Michael to resign his teaching position. Then, as a direct result of being placed on the CACI, Michael has been unable to resume his teaching career. Each time he applies for a job, background checks point to this listing and employers invariably err on the side of caution to reject his applications for employment.

The false allegations of abuse by this Philippino woman and her fraudulent intentions, has created a 6 year nightmare not only for Michael, but for little Angela as well, his innocence notwithstanding. A search for love and happiness has resulted in the utter destruction of this man's life.

Devoting full time to his battles in the courts during these six years, and with involvment of the immigration authorities, Michael has made tremendous headway in overcoming what seemed insurmountable odds. He has won several victories in the courts, but there remains more court battles ahead. At this point the 4th Appellate District State Court of California ruled Michael's rights were violated, and denying him custody of his child was a miscarriage of justice. The 9th Circuit Federal Appellate Court ruled that the prior dismissal of Michael's lawsuit against the County of Riverside was improper, and reinstated his lawsuit back in the District Court. The 9th Circuit recognized that Michael's rights and his daughter's rights were violated by the actions of Riverside County and its social workers, as well as by court officials including Judge Arthur Block. Victory in 9th Circuit Appellate Court, San Francisco.

Last June the 9th Circuit reinstated Michael Smith's federal lawsuit against
Riverside County by vacating the dismissal of his suit by the Riverside District Court
and remanded it for further proceedings.

On June 22nd, 2005 the court wrote:

This is a significant victory which validates Michael Smith's claim that
social workers and judicial officials (specifically Judge Block) violated his and
his daughter's civil rights by conducting a fraud dependency case
when no child abuse or familial domestic violence took place.

The attitude of government officials is not to help people but to invade their families and
exploit their governmental power to make money for themselves and
aggrandize the revenue schemes of their social agencies.
Rather than just asking
"How can we help you?" and then giving the help requested,
they destabilize families and inject their socialist statutory schemes
to the detriment of families and the lives of children.

THIS MUST STOP!


Most recently (April 21, 2006) the parties have stipulated that Michael's case
and that of his daughter may be combined by filing a 2nd Amended Complaint
clearly indicating which causes of action apply to each.
